A more educated driver would not have done these. It is in the officer's economic interest and benefit to arrest you, and he WILL NOT have sympathy for honesty. Whatever you say and do can and will be used against you in the court of law.
Roadside tests are considered a non-permissible search under the 4th Amendment to the US Constitution and cannot be conducted without your consent. One third of the sober population cannot pass these tests; they are designed to fail. DO NOT take them under any circumstance. You also have no obligation to inform the officer that you have been drinking, DO NOT incriminate yourself. The officer has no authority to arrest you without probable cause, DO NOT give him any. This driver was apparently not breaking any laws, but spent the night in jail, missed his business meeting, possibly paid thousands of dollars in legal fees, and lost his driver's license for one full year for failure to take a breath or blood test after his arrest for not knowing the Colorado's Express Consent law.
